THE ART OF OPTIMISM AFFILIATE AGREEMENT

Any legal claims, disagreements etc between affiliates and The Art of Optimism are to be addressed in accordance with New Zealand law and under the New Zealand legal jurisdiction.

We operate a last cookie system for our affiliate program.  In other words, the last affiliate to refer a sale through one of their links will be the affiliate rewarded the commission.

Our affiliate program is operated using ‘Infusionsoft’ and we will at all times rely on their tracking and reporting system in order to reward commissions.  If there is ever a disagreement around the ‘ownership’ of a referral, this is how the allocation decision will be made.

Affiliates are responsible for taxation, liabilities and will arrange tax payments according to their local laws.

Affiliates will at all times comply with their local laws in respect to spam and advertising.

All affiliates are acting as independent contractors.  They do not have a legal business relationship with The Art of Optimism and are not employees, JV partners or official partners in any other capacity.

Affiliates must not mislead or misrepresent to the public in any way, shape or form.

Affiliates will indemnify The Art of Optimism from any legal responsibility or claim arising from the affiliate’s actions or claims.

Payments to affiliates will be made 49 days after the transaction is confirmed.  This is because we offer all customers a 45 day unconditional guarantee.

The Art of Optimism reserves the right to terminate this Agreement and/or suspend or terminate any payments at any time and for any reason.

We reserve the right to update these terms and conditions at any time, and require affiliates to agree to these updated conditions as part of the ongoing agreement.
